The purpose of this Notice

When we provide our services to you, we will collect personal information about you and, where relevant, other individuals connected to the services we provide. We want to be open and transparent with you as to the types of information we collect, why we collect it, how we use it and who we may share it with.

The data controller of your personal information is The Premier Partnership Limited, a limited company registered in England and Wales with company number 2794326, whose registered office is 5 Pebble Close, Amington, Tamworth, B77 4RD (“we”, “us” or “our”).

What type of personal information will be processed and why?

We may ask you to provide personal information by filling in hard copy or electronic forms and documents, by corresponding with us by phone, email, letter or otherwise, through our website contact form, during meetings with you, or during the course of our fact-finding and advice process.


Identity details

This includes your name and date of birth. We may ask for copies of identity documents, in which case we may collect details including your place of birth and residential address. We collect and process this information to carry out money laundering and financial checks and for fraud and crime prevention and detection purposes, and to comply with our legal and regulatory requirements. We will only ever use copies of identity documents for this purpose.


Contact details

This includes your name, postal, phone and email address(es), and other personal details such as your title, job title, marital status and date of birth. We use this information to contact you, manage and administer our services, respond to your enquiries, discuss products or services you may be interested in, manage applications, communicate any updates including changes to this Notice, and to invite feedback and participate in related surveys.


Financial information

This includes pension contributions and current value, salary, bank account balances, credit card balances, details of investments and payment card details. We use this information to evaluate your eligibility for products, including making credit and fraud searches, to advise you on your financial circumstances and the appropriateness of specific courses of action and products, and to enable you to make payments for our services. We collect and process this information for our legitimate business interests and as necessary for the entry into and performance of any agreements between us.


Details of your dependants

This includes name, address and date of birth, where this is needed to provide services that involve or affect your dependants (who may be adults or minors). Where those dependants are adults, please make sure you have their permission to provide us with their personal information.


Details of our contact with you

This includes meetings, fact-finding discussions and documentation, recommendations, referrals, quotes, details of services you have received, client experience and other feedback, information about complaints and incidents, and recordings of calls we receive or make. We use this information to provide a professional service to you, to contact you about other services we think you may be interested in, and for our legitimate business interests including internal business planning, compliance, training, audit and quality assurance.

We may also disclose any of the personal information described above to third parties where we are required to do so to comply with applicable laws and regulatory requirements, including where required by a court order, regulatory authority, or another third party with the lawful right to request it (including law enforcement agencies and tax authorities), or where necessary to take legal advice or to establish, bring or defend a legal claim.


Special category personal data

Depending on the products and services you require, we may also need to collect information which the law considers sensitive, referred to as “special category personal data”. This may include:

● Information about your physical or mental health or condition, where this is needed to advise on and submit applications for health or life insurance products (since insurance premiums and eligibility depend in part on physical and mental health).

● Information about your sex life or sexual orientation, where a provider asks for this as part of an application for their products or services. We will never ask for this information for our own purposes.

● Information about your racial or ethnic origin, where a provider asks for this as part of an application for their products or services. We will never ask for this information for our own purposes.

We will only process this special category personal data with your explicit consent, which we ask for at the end of this Notice. You may choose not to provide this consent. However, if you do not, we may not be able to advise you fully on certain products and services, your application may be rejected by providers requiring this information, or quotes for such products may be higher than would otherwise be the case.

In some circumstances we may receive information about you from third parties, including credit reference agencies, fraud prevention agencies, employers, providers, lenders and other finance and credit organisations, where this is necessary to provide our services, assess your financial circumstances, verify your identity, meet our legal and regulatory obligations, or obtain information under a Letter of Authority. It is in our legitimate interests to process your personal information for these purposes.


When we record communications

We, and persons acting on our behalf, may record and/or monitor communications, including telephone calls, emails and other electronic communications, between our staff and you, where this is necessary to comply with our legal and regulatory obligations, support quality assurance, training, complaint handling, record keeping and the effective operation of our systems.

Where communications are recorded and/or monitored for training or quality assurance purposes, we will make this clear and obtain consent where required. This does not affect any recording or monitoring that is necessary to comply with our legal or regulatory obligations.


Who might my personal information be shared with?

We may disclose your personal information to the following categories of recipients:

● Providers of financial services, insurance and investment products and services in respect of whom you request us to submit applications on your behalf, and to receive updates from such providers in order for us to provide our services to you throughout the lifetime of our relationship with you.

● Our suppliers and partners who help us provide our services to you, including our IT systems providers, our suppliers of audit and regulatory compliance support services, and our accountants, solicitors, insurer(s) and insurance broker(s) and other providers of professional services to us.

● Providers of back-office systems, secure cloud storage, client management systems, document storage, compliance support and other third-party service providers, where this is necessary to deliver our services and meet our legal and regulatory obligations.

● Credit Reference Agencies and Fraud Prevention Agencies, to help us make the best possible assessment of your financial situation before we decide whether we can provide you with services. We are also required to provide information to such agencies so that they can update the information they hold about you, which they may share with other organisations.

● Other financial institutions or regulatory bodies with whom information is shared for money laundering checks, credit risk reduction and other fraud and crime prevention purposes.

● A prospective buyer (and its agents and advisers) in the event we intend to sell any part of our business or its assets, or if substantially all of our assets are acquired by a third party, in which case your personal information could form part of the assets we sell, provided that we inform the buyer it must use your personal information only for the purposes described in this Notice. We will never rent or sell your personal information other than as part of a sale of our business.

● Any national and/or international regulatory, enforcement body, government agency or court, where we believe disclosure is necessary as a matter of applicable law or regulation (including where we are required by law to provide information to organisations such as HMRC), to exercise, establish or defend our legal rights, or to protect your vital interests or those of any other person.

● Any other person with your consent to the disclosure, or where we are permitted to do so by law.


Our legal basis for processing personal information

Our legal basis for collecting and using your personal information will depend on the personal information concerned and the specific context in which we collect it. In respect of the personal information and purposes described in this Notice, we have confirmed the legal basis upon which we collect and process your personal information in the 'What type of personal information will be processed and why?' section above.

If we ask you to provide personal information to comply with a legal requirement, to perform a contract with you, or with your explicit consent, we will make this clear at the relevant time and advise you whether provision of your personal information is mandatory (and the possible consequences if it is not provided).

Similarly, if we collect and use your personal information in reliance on our legitimate interests (or those of a third party), we will make clear at the relevant time what those legitimate interests are.

International Data Transfers

Your personal information may be transferred to, and processed in, countries outside the United Kingdom or European Economic Area where we use third-party systems, cloud services, providers or professional service providers. Where this occurs, we will take appropriate steps to ensure that your personal information remains protected in accordance with applicable data protection law.

Where we transfer personal information outside the United Kingdom or European Economic Area, we will only do so where appropriate safeguards are in place, such as contractual protections, adequate security standards, due diligence on the third party, or other lawful transfer mechanisms required under data protection law.


Your data protection rights

● If you wish to access, correct, update or request deletion of your personal information, you can do so at any time by contacting us using the details under 'How to contact us' below.

● You can object to processing of your personal information, ask us to restrict processing, or request portability of your personal information, using the same contact details.

● You have the right to opt out of marketing communications at any time. You can exercise this by clicking the “unsubscribe” or “opt-out” link in our marketing emails, or by contacting us for other forms of marketing such as post or telephone.

● If we have collected and process your personal information with your consent, you can withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of any processing carried out before your withdrawal, nor processing carried out on other lawful grounds. For our processing of your special category personal data specifically, see the consent section at the end of this Notice.

● You have the right to complain to a data protection authority about our collection and use of your personal information. In the UK, this is the Information Commissioner's Office (ICO).

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.


Can I make a complaint?

Yes. If you are unhappy with the way we have collected, used, stored, shared or otherwise handled your personal information, you can make a data protection complaint to us.

You can make a complaint by contacting us by telephone, email or in writing using the contact details set out in the 'How to contact us' section of this Notice. If it is not clear whether your concern is a data protection complaint, we may ask you to clarify this so that we can handle it appropriately.

We will acknowledge your data protection complaint within 30 days of receipt. We will then take appropriate steps to investigate your complaint without undue delay, keep you informed where appropriate, and tell you the outcome of our investigation.

You also have the right to complain to the Information Commissioner's Office (ICO) at any time about our collection and use of your personal information, as set out in the section above.


Data retention

We retain personal information in line with our legal, regulatory and business requirements. In addition to retaining data throughout our relationship with you, regulatory minimum retention periods include three years for mortgage business, three years for insurance business, five years for investment business, and indefinitely for pension transfer and opt-out business. Where our relationship ends, we may retain your data for up to 10 years after that point, subject to the requirements of our Data Retention Schedule.

We retain personal information where we have an ongoing legitimate need to do so, for example to provide a product or service you have requested, to perform our contractual obligations, to comply with legal, tax or accounting requirements, or to defend or manage any claims or complaints between us, you and any relevant third party.

When we have no ongoing legitimate need to process your personal information, we will either delete or anonymise it or, if this is not possible (for example because it is held in backup archives), we will securely store it and isolate it from further processing until deletion is possible.


Updates to this Notice

We may change or update this Notice in order to maintain our compliance with applicable law and regulation, or following an update to our internal practices. When we update our Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make.

We will only do this where you have agreed to receive this information from us. Your marketing preferences, and your choice of contact method (email, post, text message or telephone), are recorded and can be updated at any time during the course of our relationship with you, including by contacting us using the details in the 'How to contact us' section above.


Your consent to us processing your special category personal data

As explained above, we can only process special category personal data, such as information about your physical or mental health, with your explicit consent. Where this applies to you, we will ask for your explicit consent at the relevant point in our advice process, for example during a fact-find or when completing an application for a specific product. You may choose not to provide this consent. However, please note that if you do not, this may affect our ability to advise you fully on certain products and services, may limit the options available to you, may result in an application being rejected, or may result in higher quotes being provided.
